1.1 Client – the organisation or individual who accepts an offer from Dave Talbot Ltd to provide an event or course

1.2 Participant – an individual who has agreed to participate in an event or course

1.3 Dave Talbot Ltd – the provider of the event or course and this includes their staff

1.4 Course – a part-day, full-day or multi-day training session for one or more participants

1.5 Event – a part-day, full-day or multi-day activity for multiple participants

2.1   Adventurous activities, by their very nature, involve an element of risk which cannot be totally eliminated. Every care is taken by Dave Talbot Ltd. to ensure the safety and well-being of participants. However, adventurous activities do involve the acceptance of risk and of responsibility for the consequences of the participant’s own actions.

2.2   Adventurous activities are frequently physically demanding and require a reasonable level of fitness. By presenting on the course or event participants are declaring themselves fit, free from injury, and able to participate in the activity.

2.3   All participants on a Dave Talbot Ltd course or event must be aware of this and accept the risks associated with the chosen course or event.

3.1   A non-refundable deposit of 30% of the quoted price will secure the booking and the chosen date. If the event or course costs less than £500 including VAT, then full payment will be required to secure the date. An event / date will not be secured until a deposit payment has been received.

3.2   If a site visit is required, the charge for this will be due regardless of whether or not the event goes ahead.

3.3   The final balance of the quoted price is due no later than one month before the event or course.

3.4   Only persons over the age of 18 may participate in the event unless accompanied by a parent or legal guardian in which case the minimum age is 12 unless mutually agreed at least 24 hours in advance of the date.

3.5   If a participant is undergoing any medical treatment or has a physical or medical condition (including being on medication) that may affect their ability to participate on the chosen course or event, this must be brought to the attention of Dave Talbot Ltd staff prior to the start of the course or event. Dave Talbot Ltd staff reserve the right not to allow the participant to proceed with the course or event. If this happens, a refund will not be given.

3.6   Dave Talbot Ltd reserve the right to exclude any participant from an activity if their actions are thought to be endangering the safety of themselves or others. If this happens, a refund will not be given.

3.7   Any participant who acts in contravention of the decisions or advice of a Dave Talbot Ltd staff member or undertakes independent activities during the course or event will forfeit all professional protection and duty of care from Dave Talbot Ltd.

3.8   Personal belongings are the participant’s own responsibility. Dave Talbot Ltd do not accept responsibility for any loss of or damage to any personal belongings during Dave Talbot Ltd courses or events.

3.9   Dave Talbot Ltd reserve the right to decline a booking or cancel an existing booking.

3.10   Dave Talbot Ltd owns all the media and photographs taken on an event unless agreed in advance. Photographs and media will be shared on Dave Talbot Ltd social media pages only.

3.11  Dave Talbot Ltd will not be held responsible for increased event costs due to Force Majeure. If an event is subject to an increase in price due to Force Majeure, that increase will be passed onto the participant or client.

3.12  Transfers of places between one participant and another is allowed. However, there will be a charge of 10% of the original cost with a minimum of £10 (including VAT) per person as an administration fee.

3.13  Changes to the agreed brief requested by the client or a participant must be made in writing (email is acceptable providing an acknowledgment is received) at least 4 weeks prior to an Event or Course. If Dave Talbot Ltd is able to make the changes, Dave Talbot Ltd reserve the right to increase the charges. If changes are made by the client or a participant within four weeks of the Event or Course, Dave Talbot Ltd reserves the right not to accept the changes, and regardless of this, there will be additional charges made to the client or participant to cover the unforeseen costs.

4.1  All refunds will be subject to a 30% administration fee (including VAT).

4.2  Transfers will be subject to a £10 administration fee (including VAT).

4.3  Any amendments requested by a participant after the original booking has been made must be put in writing (email is acceptable providing an acknowledgment is received).

4.4  If a participant wants to cancel or have a refund of their booking within two months prior to the race date, then no refund will be given and the whole amount remains due.

4.5 Transfers can only be made up to one month before the race start date or before the race start list is drawn up.

8.1   The price quoted is for the services, dates and times stated. Any changes to these requested by the client or participant may cause an increase in the price to be applied.

8.2  Unless otherwise stated, VAT will be added to all invoices or charges at the rate in force at the time of invoicing.

8.3  Payment is required in accordance with the terms set out in our quote which is generally within 30 days. Late payment penalties may be applied in accordance with Late Payment of Commercial Debt Regulations (2013). This includes late payment interest of 8% above the Bank of England official dealing rate plus late payment recovery compensation of £40 up to £999.99, £70 up to £9,999.99 and £100 for anything higher.
